ملخص الدراسة
هدفت الدراسة إلى توضيح الحق في حرية التنقل في ظل جائحة كورونا كوفيد 19 بين حالة الطوارئ الصحية التي فرضتها الدول وضمان الحق في الحياة باعتبار أنه إذا كان إعلان حالة الطوارئ أمر ضروري على أساس أنه نظام استثنائي يضمن حفظ النظام العام للدولة ويحفظ أمن الأشخاص وحقهم في الحياة.
لذلك حاولنا توضيح كيف يمكن التوفيق بين الحد من حرية التنقل في ظل جائحة كورونا كوفيد 19 وبين حماية الحقوق والحريات كواجبات للدولة، وفقا للنظام الدستوري مع تحول فيروس كورونا كوفيد 19 إلى وباء عالمي، يمثل خطر على الإنسانية ويهدد الحق في الحياة الذي يشكل أول الحقوق وأبرزها مما دفع أغلب دول العالم التي أصيبت بفيروس كورونا المستجد إلى إعلان حالة الطوارئ الصحية، لاحتواء المرض والحد من انتشاره؛ فسارعت الدول إلى إغلاق حدودها كما فرضت الحكومات حظراً على التجمعات في الأماكن العامة وعلقت المدارس ورحلات الطيران وتم تقييد حرية التنقل بأساليب متنوعة من قبل العديد من حكومات المجتمع الدولي أو ضمن إقليم الدولة ذاته، وبنيت هذه القيود عموماً على الصحة العامة، أو النظام، أو مبررات للسلامة، والحق في الحياة.

Abstract
The study aimed to clarify the right to freedom of movement in the shadow of the Corona Covid 19 attack between a state of health emergency imposed by the state and guaranteeing the right to life, given that if declaring a state of emergency is necessary on the basis that it is an exceptional system that guarantees the preservation of the public order of the state and preserves the security of people and their right to life
Therefore, we have tried to explain how limiting freedom of movement in the shadow of the Corona Covid 19 pandemic can be reconciled with protecting rights and freedoms as duties of the state, according to the constitutional system with the Corona Covid 19 virus turning into a global pandemic, which represents a threat to humanity and threatens the right to life which is the first and most prominent of rights This led most of the countries in the world that were infected with the emerging coronavirus to declare a state of health emergency, to contain the disease and limit its spread; Countries rushed to close their borders, as governments imposed a ban on gatherings in public places, suspended schools and flights, and freedom of movement was restricted in various ways by many governments of the international community or within the territory of the country itself, and these restrictions were generally built on public health, the system, or justifications For safety, the right to life.
